Benny's Bakehouse LLC operates as a Texas Cottage Food Production Operation. Our products are prepared in a private home kitchen in accordance with applicable Texas Cottage food laws.

THIS PRODUCT WAS PRODUCED IN A PRIVATE RESIDENCE THAT IS NOT SUBJECT TO GOVERNMENTAL LICENSING OR INSPECTION.

Products are prepared in a kitchen where major food allergens may be present, including eggs, milk, wheat, soy, peanuts, tree nuts, sesame, fish, and crustacean shellfish. Because shared equipment and preparation areas are used, cross-contact with allergens may occur.

Please review the ingredients and allergen information provided for each individual product before placing your order.

Ingredient and major-allergen information is provided on the product label or with the product as required by applicable law. Products may be prepared or packaged in a home or shared kitchen where allergens are present. Unless Benny's Bakehouse LLC expressly confirms otherwise in writing, no product is represented as allergen-free, and cross-contact cannot be ruled out.

If you have an allergy, intolerance, or dietary requirement, review the available information and contact Benny's Bakehouse LLC before ordering. You are responsible for deciding whether a product is suitable for you or the intended recipient. Product information is not medical advice.

An order is not accepted until Benny’s Bakehouse LLC confirms the order and payment has been successfully completed. All products are subject to availability, and availability may vary from week to week or seasonally based on ingredients, inventory, current order volume, and production capacity.

We reserve the right to temporarily remove, discontinue, or limit products or quantities as needed. Orders may also be declined or canceled due to errors, unavailable ingredients, fulfillment restrictions, suspected fraud, unsafe or unlawful requests, or production limitations. If Benny’s Bakehouse cancels a paid order, the canceled portion will be refunded.

Customers are responsible for providing accurate contact, customization, and fulfillment information and for reviewing all order details before submitting their order.

Prices are shown on our website and may change without notice due to inflation, ingredient costs, supply costs, and other market conditions. Benny’s Bakehouse LLC reserves the right to adjust pricing as necessary. Price changes will not affect orders that have already been placed and paid for.

The total shown at checkout includes the selected products and any applicable taxes, delivery charges, discounts, or other fees.

Payments are processed through the payment provider available at checkout. By submitting payment, you authorize the amount shown at checkout to be charged to your selected payment method. An order is not considered confirmed until payment has been successfully completed and an order confirmation has been issued.

Cancellations or order modifications must be requested at least 48 hours before your scheduled fulfillment date. Cancellations made within this timeframe are eligible for a refund. After the 48-hour deadline, all sales are final, and no refunds, returns, exchanges, or credits will be issued.

Pickup orders include a 15-minute grace period after the scheduled pickup time. If you are running late or experiencing an emergency, please text 281-946-9096 or email Benny’s Bakehouse as soon as possible. Pickup beyond the 15-minute grace period cannot be guaranteed.

Orders that are not picked up within the scheduled pickup time and 15-minute grace period, without prior communication and approval from Benny’s Bakehouse, will be considered abandoned. Abandoned orders are not eligible for a refund, exchange, or credit and may be disposed of at our discretion.

Available pickup and delivery options, locations, fees, and time windows are shown at checkout and/or in your order confirmation. Pickup orders are available at a pre-assigned public location within the 77075 area during available pickup times. Benny’s Bakehouse does not offer residential/home pickup. The specific public meeting location and pickup instructions will be provided after your order is confirmed.

Customers are responsible for providing an accurate delivery address and for arriving at the designated public pickup location at their scheduled date and time. Pickup and delivery times are estimates unless specifically confirmed by Benny’s Bakehouse LLC.

Any requested changes to your scheduled pickup or delivery must be made at least 48 hours before your scheduled fulfillment date and are subject to availability.

If you create an account, you are responsible for keeping your sign-in information secure and for the activity associated with your account. If you believe your account or payment information has been used without your permission, please contact the appropriate platform, payment provider, or financial institution as soon as possible.

By placing an order, you agree to receive electronic order confirmations, receipts, fulfillment updates, and other communications related to your order using the contact information you provide.

Benny’s Bakehouse LLC is responsible for our products and for addressing concerns to the extent required by applicable law. We are not responsible for issues caused by incorrect customer information, failure to follow pickup or delivery instructions, improper handling or storage after fulfillment, unauthorized resale, or circumstances outside of our reasonable control.

These Terms are subject to applicable law. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to apply.
